GENERAL TERMS AND CONDITIONS

Article 1 : Definitions
1.1 In these general terms and conditions, “Bestwelhip” shall mean the one-man business registered in the Commercial Register of the Chamber of Commerce in Maastricht, the Netherlands, with Chamber of Commerce number 78403103.
1.2 “Customer” means any visitor to the webshop, natural person or legal entity, who places an order via bestwelhip.nl.

Article 2 : Applicability
2.1 These General Terms and Conditions shall apply to all orders placed via the webshop bestwelhip.nl.
2.2 By placing an order, the customer accepts the applicability of these General Terms and Conditions.
2.3 Deviation from these General Terms and Conditions shall only be possible if expressly agreed in writing and in which case the other provisions of these General Terms and Conditions shall remain in full force.
2.4 Bestwelhip.nl reserves the right to change or supplement these General Terms and Conditions from time to time.

Article 3 : Agreement
3.1 An agreement is concluded when an order confirmation is sent by e-mail to the e-mail address provided by the client. Once the order is confirmed by e-mail, the customer and Bestwelhip.nl have a valid agreement. This electronic confirmation shall hereby serve, to the extent permitted by law, as a presumption of proof.
3.2 Only orders with a clear name, address and telephone number will be processed.
3.3 Reserved items will be held for a maximum of 10 days. After these 10 days, reserved items will be offered for sale again, unless otherwise agreed in writing.

Article 4 : Personal data
4.1 The data provided by the customer shall be treated confidentially by Bestwelhip.nl and shall be used for the following purposes:
– Processing the order, its payment and delivery to the correct delivery address
– Improving the user-friendliness of the webshop
– Providing information about new updates, possible offers and newsletters in the future (if the customer has opted for this).

Article 5 : Offers
5.1 Bestwelhip.nl mostly sells used articles (vintage), possible traces of use cannot be excluded. This belongs to the product. Without requesting further information, you agree with the condition of the article.
5.2 Information, descriptions, photographs/images, statements made orally, by telephone or by e-mail provided by Bestwelhip.nl with regard to the offer are given or made as accurately as possible. However, Bestwelhip.nl does not guarantee that all offers and products fully comply with the information etc. provided. Deviations shall in principle not give rise to damages and/or dissolution of the agreement. If the product deviates to an obvious degree from the information on the website, Bestwelhip.nl shall take appropriate measures to accommodate the customer.
5.3 Bestwelhip.nl usually sells the lighting with the original wiring that does not always (anymore) comply with current rules/standards. Bestwelhip.nl recommends consulting an electrician before use. Bestwelhip.nl sells the lamp exclusive of the light bulb.
5.4 Bestwelhip cannot be held to its offer if the customer should have understood, within the term of reasonableness in social views, that the offer contains an obvious mistake or clerical error.
5.5 As products cannot be automatically removed from the site after ordering, it is possible that a product is ordered/requested by two customers at the same time. If this happens, the product will be sold to the person who ordered the product first.

Article 6 : Prices and payments
6.1 All prices indicated by Bestwelhip are expressed in Euros. All prices do not include shipping costs.
6.2 95% of the articles offered are margin articles (i.e. not VAT articles) and are subject to the margin scheme. For margin articles, no VAT is mentioned on the invoice. VAT is therefore not deductible. If you want to know whether an article is a margin or VAT article, you can request this by email.
6.3 Orders via the website can be paid in the following ways:
– Cash payment on collection of order (this is done by appointment, in consultation with the customer)
– Payment in advance by bank transfer; the customer transfers the amount due including shipping costs to bank account 1600.57.086 in the name of S.Snijkers in Maastricht, stating the article description. The amount due must be credited to the relevant bank account within a maximum of 7 days. If this term is exceeded, the agreement shall automatically be dissolved by Bestwelhip.
6.4 The product will only be shipped once the full total amount has been credited to the bank account. Once an item has been ordered, it will be listed as ” reserved”. If payment has not been received 5 days after ordering, the item will be put back on sale.
6.5 Bestwelhip.nl expressly reserves the right to change prices, in particular when this is required by (legal) regulations.
6.6 Special offers shall only be valid for the period of validity as indicated on the website in relation to that special offer.

Article 7 : Shipping costs
7.1 Shipping costs Netherlands: rates according to TNT Post , these are mentioned on the website or can be requested via Bestwelhip.nl’s contact form.
7.2 For shipping abroad, a different rate is calculated per country depending on the weight. In this case, Bestwelhip.nl must first be contacted by e-mail.
7.3 Subject to typing errors and errors in the calculation of shipping costs.
7.4 If the customer is not located in the country of dispatch, the customer shall be liable for any turnover tax and/or import duties due.

Article 8 : Delivery
8.1 Collection of the goods shall only be possible by appointment, this shall take place in consultation with Bestwelhip.nl. In the case of fragile items in particular, collection is preferable!
8.2 Bestwelhip initially delivers only within Europe. For orders from abroad, contact should first be made via email regarding the level of shipping costs. Different delivery conditions apply to deliveries abroad.
8.3 The articles are packed as well as possible for shipment. However, should damage occur during shipment, Bestwelhip.nl shall not be liable for this.
8.4 Upon receipt of payment, Bestwelhip shall dispatch the order within seven working days. The indicated delivery time is indicative and shall never be regarded as a deadline. Failure to meet any delivery deadline shall not entitle the customer to compensation nor to cancel the order or rescind the agreement, unless the failure to meet the delivery deadline is such that the customer cannot reasonably be expected to maintain the agreement.
8.5 Delivery takes place at the address given by the customer during the conclusion of the agreement.

Article 9 : Retention of title
9.1. Ownership in respect of the products is already transferred at the moment the products are presented at the delivery address specified by the customer. If the customer fails to take delivery of the products, the resulting damage and costs shall be for his or her account. Possible return shipments to Bestwelhip.nl shall be at the expense of the customer.

Article 10 : Return
10.1 If desired, an item can be returned at the customer’s expense. This must be reported by e-mail immediately after receipt. Return is possible within 7 days after purchase/receipt of the article, only if the article is in exactly the same condition as when sold. Costs incurred for shipping to the customer and/or returning or bringing back items, shall be borne by the buyer.
10.2 The purchase price will be returned after the process of article 10.1 has been properly completed.
10.3 Bestwelhip.nl reserves the right to refuse returns or to refund only part of the amount if it is suspected that the products have been used or damaged by the customer or third parties.

Article 11 : Intellectual property
11.1 The customer expressly acknowledges that all intellectual property rights of displayed information, images/photos , communications or other expressions regarding the products and or regarding the internet site or its promotion belong to Bestwelhip or other entitled parties. Photos, images of Bestwelhip.nl may not be used without permission.

Article 12 : Force majeure
12.1 If one or both parties are hindered as a result of a circumstance not attributable to fault, force majeure, both parties shall not be obliged to fulfil any obligation.
12.2 The parties may suspend the obligations under the agreement during the period that the force majeure continues. If this period lasts longer than 2 months, either party is entitled to dissolve the agreement, without any obligation to compensate the other party for damages.

Article 13 : Compensation
13.1 Bestwelhip.nl can only be held liable for damage which can be attributed to its intent or fault, or which has arisen due to circumstances which are at its own risk.
13.2 Bestwelhip.nl shall not be liable for damage caused by third parties or for consequential damage resulting from improper use or from a defect unforeseeable by Bestwelhip.

Article 14 : Applicable law and competent court
14.1 Dutch law shall apply exclusively to all rights, obligations, offers, orders and agreements to which these General Terms and Conditions apply.
